Hi,

first of all I thank everyone here for providing the immense information.

I got my Visitor visa approved (10 yrs) on 18th Dec 2008. My friend sponsered me.

Me: Good Morning
VO: Good Morning! how are you?
Me: Very Well thank you!
VO: What is the purpose of your visit?
Me: Meet my friend and for tourism.
VO: how long you know your friend
Me: 4 yrs
VO: for whom your friend works in America
Me: answere xxxxx
VO: How did you meet your friend?
Me: we were collegues in past!
VO: What is the name of your friend?
Me: He is not married yet!
VO: What was the purpose of your last visit? (I had been to USA On B1 which was issued for 3 months.
ME: Answered the query..
VO: When did you return from your Previous visit?
ME: Answered xxx Date/yy
VO: Looked at my passport the dated stamped by Hyd airport authority.
VO: how long you have been working with current company?
ME: answered xx yrs
VO: Do you have your leave approval letter?
ME: Yes! i do have and i gave the leave approval letter
VO: Congrats! your visa is approved, Merry X-mas.

I need some advice I met my husband in 2002 and we were inseperable. We decided to marry in 2004 and we had a beutiful son Jan 2005. Since 2007 we have been seperated due to many marital problems. I have since then made the decision to file for divorce. His responce has been that we needed to wait a while per his attorney it is not recommended because immigration would be under the impression it was fraud. And that they would take his GC away? The thing is they gave it to him for 10yrs why do I need to wait to move on with my life. Also he convinced me not to file for child support because he said it would affect his legal status? I cant afford an attorney so I was hoping someone can help me answer these questions.

Hi all. well i got married on aug 28. i have my marriage certificate widm e .. my husd\band is a us citizen & i came over on my K1. now. .i wud want to knw wot all wud i need to fill in & how to apply for adjustment of status & hw much time wud it take for my social security etc so that i can atleast get a license & start work!

To apply for the EAD for H4 person is their presence mandatory in USA, can they leave the country for short time?

Im waiting for a name check clearance from the FBI,did renew my EAD twice and the last time was expired end of may 2008. renewed it late end of june fingerprinted on aug 1,2008.my driver license expired on july 25th of 2008 and couldnt renew it since my work permit was expired. any suggestions so atleast get my driver license renewed? please need your help

I'm about to file I-485 for my mom. She currently has a tourist visa which will expire on September, 2008. Do I need to apply for a separate tourist visa extension (I-539), or is her tourist visa automatically extended with the I-485 application?

Appreciate any feedback.

Originally we applied for the I130 and it was approved and then he was supposed to go back to Chile to complete the process. We got the approval but had not got the interview date to take place in Chile.

Well he ended up staying over the visa date so a year and 3 months after applying for the K1 we switched paths and applied for the 485 and 864. This was in Dec. of 07.

We had our interview today. We took originals and copies of everything on the appt. notice. We took photos. We drilled each other on questions and answers based upon other stories we had heard.

We got there, went throug security, put our notice through the slot and waited for about 15 minutes. We got called back, it was a lady officer. She only asked him-us about 10 questions total and we were like ¨WTF¨ I guess we were blessed or something. Maybe because we are in Dallas and the majority of ppl going there are all Mexican illegals, and my husband is from Chile and we met in Iraq.

She anyways, said he was approved, we´d been married for over 2 years so he was considered a permanent resident effective today and we´d get the green card in the mail in 1 to 3 weeks.

2 Cases, Myself and my Wife.

Myself: EB2 PhD
Started process 8/04 TOTAL 3.5 Years
Labor Cert Approved 1/05
I-140 Approved 4/05
I-485 Applied 5/05, EAD/AP 5/05 approved
FP 1 7/05
EAD/AP 3/06 approved
RFE 1 6/06
FP 2 10/06
EAD/AP 1/07 approved
RFE 7/07 Used AC 21 for I-140 portability
EAD/AP 12/07 approved.
I 485 Approved 2/08 No Interview.

Note how the silly EAD gets only 9 mths for every renewal as you need to time the waiting time vs your expiration date. Lots of $$$ there.

Wife Derivative

Married 10/07
Applied 11/07 from F-1 visa
FP 1/08
AP/EAD 3/08
I-485 conditionally approved TODAY!! 7/16/08

The marriage must occur before my principal I485 is approved. Then derivative status is possible.

Interview went only for 20minutes. As marriage is less < 2 years, conditional. Submitted copies of marraige cert, bank accounts, credit cards, tax filing, lease contracts, vacation receipts, health plan copy. Conditional Green card to remove condition 1.75 years from today ie. 4/15/10. Same process, submit all 2 name documents on I-751 + $500+ OUCH!!

Immigration officer was professional, no jokes, no smile, but polite. She asked for A, B, C, docs in sequence, punch 2 holes and file it. Copies my GC and DL + wife DL, then "OK, I will approved it conditionally, please submit I-751 in 1.75 years." "welcome to USA".

Good luck to all of you, I have waited 3.5 years for myself, got married with the right girl, so happy she has no problems.

We had a very speedy case (13 weeks). Unusual we think. But it did have its stressful moments nonetheless.

Lawyer:
We did not use a lawyer, except for a one-off initial consultation. But ours was a relatively straight forward case.

Facts:
Engaged early 2005.

Applicant was from Australia, then came to the US on F-1 student visa 2005-07.

Married US citizen late March 2008. Filed I-485 and other forms a few days later.

Applicant was fingerprinted 4 weeks after submission.

EAD arrived 9 weeks after submission.

Interview occurred 13 weeks after submission. Green card approved at the interview.

The interview:
40 minutes. Interviewer talked for the majority.
Questions asked:
- how did you meet?
- when did you meet?
- how long have you been together?
- where did you study? (to both spouses)
- what do you do for a living? (to both)

Evidence requested at interview:
- Applicant's original birth certificate
- Original marriage certificate
- photos (viewed all, kept one for the file)

Advice:
- Obtain IRS tax transcripts by calling 1800-829-8374.
- We used the Applicant's income and assets to supplement the Sponsor's income. We put the Applicant's financial info on the Sponsor's I-864.
- Don't be afraid to laugh and engage the interviewer in a conversation (we talked about Australia). Nervousness invites suspicion.

I am currently preparing all my forms for the greencard. I am a German citizen and my husband is in the US Air Force...I dont want to hire a lawyer cause the greencard itself is already very expensive, but I feel like there is no other way to get help when we have questions.
Does anybody here know a good immigration lawyer in the wichita falls area??
