Hi,
Just wanted to know what is the criteria for EB2 labor certification. Is it just experience/education or are there are any designation restrictions too? If anyone has more information pls to e-mail me at janikatta@gmail.com.

My company says it is very difficult to get my labor approved because I joined the company fresh after doing my Masters in Ind. engineering.
Did any of you face the same problem?
They also said that PERM is very difficult to get approved as it asks for for ads through more media than the regular process.

i got my state labor approved in feb 2004 from MD but fedral processing is july 2003 for PA from last 6 months, dates are not changing on line i wonder what they are doing or just the website is not being upated. any one has similer sitution with PA DOL.

I started my process of transition from H1B to permanent residency by filing with DOL in August of 2001 for a Labor Certification. It is now October of 2004 and as of yet of heard nothing. My company and I have spent over $25,000 in legal fees on this process to date and yet nothing. I am from Canada, run a very successful business in Seattle, pay a tremendous amount in tax, and yet can't get this process completed so that my family, kids in particular can work. I have 4 children, ages 15-20, what am I teaching them of this great country when they feel handcuffed by a process that is beyond ridiculous. Frustrated, you bet!

AFTER INS DENIED POLITICAL ASYLUM PETITION, I HAVE AN ORDER OF DEPORTATION BUT I GOT LABOR CERTIFICATE BASED ON 245-I (APRIL 2001). WHAT'NEXT; WHAT CAN I DO . PLEASE, IF SOMEBODY CAN HELP, LET ME KNOW VERY SOON.

A friend of mine's despeerate. He lives in Maryland. His sponsor filed the correct paperwork with the USDOL in New York. Papers were entered before APril 30, 2001. Is this delay in obtaining certification normal? My friend wants to bring his wife of 20 years and 3 children and is concerned that now his almost 21 year old son may not qualify for the visa when the time comes. He wants to know how long after labor certification is granted and immigration procedures begin, can he estimate on his family being granted a visa to come and join him. What's worse, his wife applied recently to the US consulate overseas for a visa to visit the US and she was denied the visa due to the consulate finding of her husband's 245-i process in the US.

Hi,
I have applied for labor in Dec 2002 and got an enquiry from Texas Workforce in July 2003. Then it was send to DOL and got a case id, bbut now it says that the current processing is Dec 2002 and my case date is July 2003. Does anyone have any idea why this is taking so much time?

Same here.My case was sent to the DOL in Feb 2003 and still waiting on. The processing time has been at Dec 2002 for the past 4 months or so.

I submitted my Labor November last year. I received a call from my lawyer that the State Agency approved the Labor and submitted it to the Regional Office. It's been more than a year and The regional office is still processing.
I wonder how long it will take to get the approval of my labor certification. At this time, the web site is posting they are processing December. Oh Man !!!
