My sister is waiting for her priority date to come up (April 2008) in order to apply for Adjustment of status. When she got the I-130 approved the Visa Bulletin board showed July 2005 as the current priority date but then it went way back to 2003; Today it is at Octo 2003. Do these dates go back and forth? How long does it usually take to get your priority date to come up?
I read on ths website that "between the time the adjustment of status application is filed and it is approved, the applicant is considered to be in legal status as an "applicant to adjust status."
Does that mean that we can submit the adjustment of status at any time; like next month, before her priority date comes up, thus permitting her to stay in the country until the VISA is available? And if so, can she apply for permission to work in the US during the wait?
