Hi...

I came to US in the Month of May, 2005. I had L1B VISA which got expired on Dec, 2005 and my petition also expired on Dec, 2005. But I have my I-94 Valid till May, 2008.

Now my question is, if i want to extend my petition, what is the possible way. If I want to go to India and come back in a Month what is the possiblity.

Is there a way for me to extend my Petition by this time, so that i can go to India and just apper for Personal Apperance.

In my senerio, i can stay in US till May 2008. If i need to go to India in any case and come back in a month, what can i do at this point.

Plz get me you suggestion.

Hi,
You will continue to be in legal status as long as the period on your I 94. If you happen to travel out of US and re-enter, then you will need a valid visa on your passport. The best route is to ask your company to file for your L1 extension while you are there, travel out only after that is approved, and you get the notice of Action (I 797), and with this new approval, get a L1 visa stamped at the US consulate in India( You will qualify for emergency appointment and can attend the visa interview at any of the 4 consulates wherever the earliest date is available acc to your convenience).

Hi ....

As per your suggestion, when i asked my company VISA section, they are saying like its not possible to apply for the Petition extension since my I-94 is valid till May 2008. What will be the possible solution for this ???...

Is it like can i apply for a new petition (Pre-petition). If so can you get me some details regarding this.... I'm also trying to find some solution to get my extension....
