View Full Version : HAS ANYONE BEEN DENIED RE-ENTRY IF PR for < 5yrs?

Hi - I really need your advice. Hopefully someone can help me.

By the time my PR was approved, I had obtained a job in the US (H1B). I landed in 2002 but decided to continue working in the US. So I returned to Toronto any chance I have had vacation - total about 4 months in the last 3 yrs.

My contract is now up here and I would like to permanently reside in Toronto. However, I have lost my PR card so I have to apply for a travel permit at the embassy. Technically my 5 years will end in March 2007. However, I will not have spent 2 yrs by that time...more like 1yr, 4 months.

Does anyone know if the emabssy will not give me the permit now because of this? If they do, does anyone know if Toronto Customs may decide to deny my re-entry and cancel my permanent residency? That would be emabarassing. Any advice/help would be appreciated.

To maintain permanent residence status, a person must spend 730 days in canada in 5 years from the date of landing.

If you donot meet this requirement, you need to apply before you come to Canada.

i have faced this situation..

i lived outside canada for 2 yrs 11 mnths and when i returned to canada for a visit was stricly told that i could not leave canada for even a day if i had to continue wiht PR...

anway i did not wish to continue with PR ..and came back..

Now if i need to go to Canada i think i will need a visitor visa..
