1) My lawyer filed for my I-140 on May 26th. I checked the case status and Vermont service center
says that it will take 30-60 days. Do you guys know how much is the truth in this as I havent
received it yet.

2) My lawyer has misspelled my dependent spouse' name. She thinks that she can correct the name
at the time of filing I-485. Is this right? What if I go for consular processing? Will it create
any problem?

3) I havent specified consular processing at New Delhi in my I-140 application. I requested my
lawyer to file an amendment to my I-140 application regarding the above. She said that INS will
provide 15 days time to respond after the I-140 approval for consular processing versus AOS decision to the lawyer and candidate. Is this true? I am afraid
what if shes wrong, in that case I will have to apply I-824, which might take a year.

4) I do not have my birth certificate with me. Do you think I can file for consular processing
without the birth certificate and then arrange the same before my interview?

5) Can I use one I-140 for AOS and another for consular processing at the same time if
I have two I-140s.

6) Any feedback on Consular Processing in Delhi, India?

1. I140s are moving faster now than it used to (mine took 12 months), but don't plan based on expected time - it never works out.

3. My advice: get it done right now. From all that I have read, the best time to do it is when you file the 140, or failing that, before it is approved.

4. You do not need your birth cert until you go for the interview. So, that should not hold you up. In any event, if you do not have one, the legwork can be quite demanding (esp. for non-availability cert), so get started early.

6. There is persistent debate (on all boards) on the topic of whether Delhi accepts ACI140 or not. But, if you get your 140 changed to CP, you won't have to worry about this.
