can we apply for ac 140 with a I140 in 6 mnths

WE got iour I140 yesterday, within 6 mnths since our status is an L1A, EB1.we want to apply for consular processing in india.(a) can we prove that it is a hardship case,(b) if it gets rejected, could we still apply for I485 in the united state. thanks in advance to all who r going to respond to the query.
