hi there,

my bf and i are applying for k1 visa. unfortunately, my sister has been living illegally in the us for 4 years. in the ds-156 form, there's a question wherein it's asking for my relatives in the us. do i have to declare it or not? kindly what is the best advise that you could give.

I am in the process of a K1 fiancee visa ... my fiancee's parents both have their greencards, and his mom is here, his dad is in Trinidad. However, on the form, the perm. address is what it asks for correct? Even though she is technically here, her perm. address is in Trinidad. My lawyer did my documentation, but I do believe that it only asks for her perm. address? Is that correct or not? My point is, if it asks for her Perm. address and that is all, then put her perm. address which is not here ... it would obviously be where you are from.

Either way, it wont affect your petition. BUT it will be very hard for your sister if she gets deported. You should tell your sister to get a lawyer or a work visa for her to be able to adjust her status and be a legal alien in USA. Although, there is no 100% assurance now that her AOS will be approved since there has been a lot of changes in the immigration. They are more stricter about illegal alien. Anyway on the form it only ask about IF the immediate family stays legally.

You will be asked on the interview about it, that is if you put on your DS form that you have a sister living in US. Be ready when you wish to do this route
