View Full Version : Can one hold H1-B and L1-B at a time?

Hi,
I have 2 queries.

1) I have a valid L1-B with me. I want to join a company in the USA. The H1-B interview for that company is on August. If I get through the i/v, then will be L1-B with current compnay be valid? or will it affect in anyway for my H1-B interview?


2) My friend is having H4 visa for his wife through his company. Now her company is processing L1 for her. Once the L1 is issued, will the H4 be valid?

Under immigration law, you can only hold one type of non-immigrant status at a time. Therefore, you cannot be in L-1 and H-1 status at the same time or H-4 and L-1 status at the same time.

If someone is in H-4 status but then obtains a change of status to L-1, s/he is no longer in H-4 status.

If you obtain H-1B status, then the L-1 is no longer applicable.
