I have been working for a US employer on a L2 EAD for the last 2 years. Now as my spouse is returning back to India I have to travel back too. My current employer is asking me to work for them from India from home. This is a good offer for me but I have a few questions:
- Is this legal?
- My employer says that they will treat me as an independent contractor and pay me the hourly wages which they will credit to my bank account here. They will also provide me with the 1099. Do I need to pay taxes in US?
- If I have to pay taxes do I need to pay Social Security and medicare or just income tax.
- If I have to pay Income tax here do I have to pay tax back in India too?
My employer says this is legal but I want to make sure so that I don't get into any problem. Any advice is helpful.
