View Full Version : Citizenship for Me, my wife & son

I will complete 5 years as a permanent resident (Green Card) in United States in October’ 2006. I am preparing to apply for the US Citizenship, along with my Wife & Son. They both got the green card with me 5 Years back. None of us are US Citizen yet.

Do I need to file separate applications for each of us? If yes, then which forms should we be using for each of us?

Any help is highly appreciated.

You need file N-400 for every one and include applicable fees seperately. You may send all the applications in one envelop though.

Visit www.uscis.gov for more on the forms and other requirments. It is really helpful if you do some prelimnary ground work for yourself and then apply so that you don't regret later for not doing any research earlier on in the naturalization process.

You need not file N400 for your son if he is a minor(under 18) when on eor both parents become naturalized citizens the childrn become US citizens automatically provided they ahve green cards and are under the age of 18 at the time.

Children under 18 cannot use N400. But they do not become citizens automatically either, when parents (or one of the parents) become naturalized citizens.

But the children can derive citizenship through one of the parents and become citizens themselves. This is a seperate process. The N600 form is the application, where one Naturalized citizen parent will be referenced for this application. The parent's naturalization certificate is required to complete this process.

You're getting caught up on semantics. Whats the practical difference between 'deriving" citizenship and "automatic" citizenship, obviously derived through your parents becoming naturalized citizens? The question was, does he have to apply for citizenship for his son and wife. The answer is no, u dont have to for your son. The minor child in this case automatically derives citizenship when the parent naturalizes.........he obtains proof of his citizenship by applying for and obtaining a certificate of citizenship............

A child does NOT become citizen automatically. The child will retain their original citizenship unless one applies to become a US Citizen. That, I'd say is clearly not automatic.
