After applying for 824, can still do AOS

My AC-140 is rejected at Madras, so with recent state departments memo, i want to apply for 824, and get receipt take the same application Madras.

If application is rejected or getting delayed for some thing, i also want to AOS? Can some think of any issues in this approach, pl suggest. i do not want to get struck in 824 and loose time not applying AOS at the same time

No one can have the best of all worlds at least the INS seems to threaten dire consequences.

What the INS claims is that if you file I824. It will consides AOS as cancelled. So they are capable of doing it so don't keep jumping fences. With the new immigration bill AOS maynot be that bad so wait and make a wise decision.
