Hello,

my father died on Monday. he became a USC last month and my sister is a PR since 2000. however, there is an issue..She lives primarily abroad to study since my parents are aged. she is staying on a Travel permission from USCIS.

my questions are: will she still qualify for USC? how? she is a minor and can my wife apply for her through adoption? will that have to be done separately?
Or does she have to wait till my mother becomes a USC?

Thanks......

Need clarification: If your sister is a minor, she will automatically become a citizen when your dad became a citizen. Didn't your dad submit N-600 for her when he became US citizen?

He became a USC in Feb and died in about 3 weeks. i was preparing her forms and did not have copy of her information to mail. as per USCIS website, i was supposed to do that..

But now, that he has passed away, what are the options? She is 11 years old and my mother has been a PR since 2000. do i need to wait until my mother becomes a USC?

Thanks...

Sorry to hear about your loss. I don't know the answer to your question. Let's see whether anyone else responds to your query. You might want to contact an immigration lawyer.
