Hi,

My mother and grandparents were born in India in the state of gujarat. My grandparents and mother moved to Kenya, africa when my mother was one years old in 1938.

Would I be eligible for OCI? if so, would my mothers passport be sufficient evidence if it showed where in India she was born and what date. If not, what other evidence is required.

Is it as simple as that?

The OCI rules say that a person is eligible if himself, a parent, or a grandparent was eligible to be a citizen of India in 1950.

Article 8 of Indian constitution says that a person residing outside India in 1950 but who himself, a parent or grandparent was born in India was eligible for citizenship by registering at an Indian consulate.

Given the above facts, it seems to me your grandparents and mother may have been eligible to be a citizen of India in 1950. So the fact that they left before 1950 would be no bar to your OCI application today.

Have you tried asking this question to any other authority like your Indian consulate?
