pending B2 extension

Hi everyone!

I'm currently in the US with a B2 visa and my I-94 expires on the 20th. We applied for an extension last week because my uncle asked me to stay for a while. I'm scared that this might affect my future entries here in the US since I have a multiple entry visa and that I will probably receive the USCIS' decision way after my I-94 expires. It has also been an issue for me as I have heard a lot of stories about people getting denied. I'm only 20 and my uncle only passed an Affidavit of Support with the application, so my chances of getting denied are huge. You have indicated here that the law does not give a time frame as to when I will leave the country when my application for extension gets denied. If ever I will get denied and leave within 5 days after I received the letter of denial, does that make my visa null and void? I mean, can I still use my b2 visa and go back here in the future?

I dont understand why you had to extend your Visa. Just because yr uncle asked to ? You are 20 years old and should know its bad for yr re-entry. Dont wait for the xtension. Leave the country soon so that you dont have trouble in future.

I have to agree with Raj.

As a 20-year old you were really lucky to get a visa in the first place.

Even if you had a valid reason to extend your stay you would be inviting trouble by applying for an extension. In your case, you do not have a valid reason. That makes your situation worse.

While entering the country you probably mentioned that you would be staying here only for a few months. Now by extending your stay you are proving that your intention to return is under doubt. There is a good chance your application will be rejected. And whether or not your application is granted or rejected, the next time you come to the US (even if it is for a valid/genuine reason) you may be granted only a shorter stay or you may be sent back to your home country from the airport itself.

So don't risk losing your visa and your future chances of visiting the US. Leave the country before the 20th (the sooner the better).

If I go home now, within the validity of my I-94, what will happen to my pending extension application? Can I still go back here in the future? Will it not affect my chance of reentry? Thank you for your kind answers.

I dont think so. You can show the return stamping on the passport at the POE next time. You could save the boarding pass along with the passport (if in case a question arises next time)

If you leave the country before your I-94 expires your extension application will not matter.

Please do however wait at least one year (preferably longer) before you reenter the US. The fact is with a tourist visa you are expected to spend a longer duration of time outside of the US than within the US.

And as Raj mentioned save your boarding pass so that the next time you visit you can prove to the Immigration officer at the POE that regardless of the extension application you left the US before your I-94 expired.
