Time for filing Labor

Hi,

My 6 year stay in US will be completed by October 2008. Is there any rule that my Labor has to be filed 1 year before completion of 6 years in order to get H1 extension ?

actually the rule says to get an extension based on LC filing, you the labor application needs to be pending at least 365 days or if approved then I140 should be filed.
