VISA Query

Hello,

My brother has been residing in USA for last 8yrs. Now he is now on 245(i) benefits. Can he apply for his wife and kids' Green Card along with his? Can he sponsor his wife for short USA visit? His wife and kids have never been to USA.

His wife and kids may be eligible for follow-to-join benefits. He can not sponsor her for a "short" visa though... I am sure you brother planned a "short" visit 8 years ago and ended up staying right? if that is the case, he abused his visa... and a visa abuser can not sponsor another one...

Also, he is going to have a problem proving an on-going marriage, when they have not seen each other for 8 years...

Thanks a lot for your reply. My brothers wife and kids desparately want to meet him. If there is any advice that you can provide so that they can visit him in the USA, we would be extremely grateful. 8 years is a long time to wait, I am sure you will understand.

Someone told me that if my brother cannot sponsor then some one else can.
Is that possible in your view.
