I am currently working with companyA and CompanyA is holding my H1B.
Just few days back I got good offer form CompanyB and interested in Joining companyB. But now problem is I have a agreement(signed by both parties) with CompanyA which says if I will break agreement within a year then I would have to pay $10,000 to them, since they have spend some money in bringing from abroad. But I am breaking this agreement Just after 3 months.

Now, my question is whether this agreement and paying that much amount is legal or not ?

Yes, it is legal. And your employer A could pursue this agreement to extract money from you or sue you.

Can the employer still sue and win on me for breaking the agreement if I am not happy working for him ?
For example, in my case I have the following points against him:
* he is not giving me my pay stubs
* he made me pay for my H1b filing charges (in the name of security deposit though!)
* He did not pay me for my 2 weeks vacation

He can still sue you.

You can present your arguments and they can present theirs.

And the court will decide what to do.
