During the past year I have established a new business in the US. Due to the construction phase I was staying almost 11 months in 2007 on my B1/2 visa. (I went home to Denmark after the first 5 months and reentered 3 weeks later)
When returning I was told that I had the wrong visa, and was granted only 3 months stay.
The Immigration officer told me that next time I enter the US I should not use business as the purpose of my stay and that he put it in to my file.
What will happen next time I try to enter?
Can I apply for an E2 visa during this next 3 months?
My investment is $1.8 mill
