View Full Version : wrong salary specified in labour cert

Hi,
It is time to file my I-485, but an issue has come up. My employer by mistake filled in wrong salary in the labour approval (which is much higher than I am making now), and now my lawyer sees problems while applying for AOS. Did anyone come across this kind of situation before. My labour and I-140 were approved fine.

I believe and heard it is okay as long as your present salary is more than the salary mentioned in LC.

It should be O.k if your employer gives you a letter stating that you would be paid the Salary mentioned on the Labor Certification or higher after receiving the approval of permenant residence application. Remeber GC is for a future job.

Have you filed your I-485? How did you solve the salary problem and how has the case been going since? I got a similar problem as you did (I-140 approved but current salary is not as high as specified in LC). Your experience may be a great help. Thank you.
