Does anyone have any experience with rejection of 485's that include affidavits by adoptive parents regarding the entry of their adoptive children? I have a couple that watched the bio parents get waived through the border, left the child with adoptive parents and returned to mexico. They included an affidavit swearing to the events with their 485, but it was rejected for lack of proof of child's current immigration status. We want to file a motion to reconsider, but want some similar experiences or case law to rely on. Any help? Thanks.
