View Full Version : 140 inprocess, can I transfer to other H1 to get after 6 yr.

I am in the 6 th year of H1 & LC is approved & I140 is just applied in Nebraska.
my company may be going out of bussiness(Shut down) within 2 months.
my question is "can I use new H1 & transfer current GC process so that I can get 1 year extns for moving into 7 year".

2nd question is "if the first question is not aplicable can I use the LC of the first company used for the LC aplication with 2 nd company so that I can directly apply I140".

You can't use LC...it has to be applied again.
but if you get 140 approved...you preserve ur priority date, which can help you apply new i-140 after new ld approved.

I would love to know the situation after 6 yrs...how to get h1 after that, don't know...


hope ur company survive...and you at least get ur 140 approved...which means you can keep your priority date infinite time...would be helpful if 140 backlog starts to increase.
