Hi All:
What happens when I140 has been applied and you quit the job. If petitioning company does not withdraw the application, and if I140 goes thru, then is the I140 valid.
-thanks!

If you have just filed the I-140 and quit your jobs, the I-140 is not valid. The I-140 is based on the employment offered by the employer who sponsored it, therefore when the employment ceases, so too does the vailidity of the I-140. If the I-140 was filed and appreoved 180 days ago, a new employer can take over where the old one left off.

I am EB3 (PD FEB'99).
My I-140 approved 180 days ago. Now i would like to change the employer. My question is
Do i have to restart my Labour/I-140 again with new employer or I can use my old I-140 and PD to file I-485 with new employer?
Any advice would be highly appreciated.

Hi,
I am in a similar situation. I-140 got approved six months ago, and now I have to change my job.
My question is: Will I be able to use my old priority date? Can my old employer get replaced on my petition?
An urgent reply is highly appreciated.
Thanks,
vikas
