Hi,
I appreciate if you could help me answering this qns.
I would like to thank you in advance for your help in the board.
* I am on H1, H1 cap(6yrs) expires next yr feb.
* Applied for GC in TX oct 98 regular/eb2. LC is not cleared yet but my file moved to DOL from SESA dec 2000. I talked to TX dol current date is 10/03/99. I know for a fact I willnot get my GC in TX for another 3-4 yrs.
* Instead of applying in RIR again I am planning to apply under nebraska or vermont jurisdiction.
* My H1 is expired last dec, waiting for h1 extension papers.
Qns:
+ Can I apply new H1 with reciept from the lawer that H1 extension is applied or do I have to wait to get my h1 extension papers first, it is taking lots of time.
+ What happens if I apply new H1 itself instead of H1 transfer ?
+ Since I have only one year, is it a good idea, I apply GC from nebraska or vermont under RIR/EB2 with different company.
+ Any other options I have ?, since I have to apply I140 before Feb 2002 to stay in this country bcz of 6 yr. cap.
