View Full Version : Advisory opinion question: Urgent!!!

Please, give me some advices, I really need it..

I was J1 without 212e for the first two years of my J1 status, but for the third visa interview, the consul told me that I am subject of 212e rule, because the skills list was updated and my country is already in the list. This was very confusing, because skills list was not updated since 1992 or something and no official amendments or anything is publicly available. So, I submitted the request for advisory opinion. I got the letter that I am NOT subject of this requirement. I went to my country just to visit my parents and I went to consulate to get my another visa in order to come back to US. I obviously submitted advisory opinion letter from Department of State along the visa application documents, but the consul said that my country government requested the skills list amendment or something, it is not officially updated in DOS, but US consulate sent notice for amendments. she disregarded the letter and gave me the 212e again.... now I am back to US and was planning to transfer to H1 visa, but the visa counselor from my university told me that I would need to apply for another advisory opinion, because the current visa was issued after my advisory opinion. I am very confused... do I really need to apply for another opinion? my current letter does not say any word that would be changed in new letter if I get the same answer, as the numbers and everything is the same... the letter is not dated either... I'm afraid of submitting the request of advisory opinion coz I might not get the same result again, but I do not want to risk my H1 application either.... Please, give me some advice...

ok, I talked to visa office at department of state and they told me that I do not need to submit another advisory opinion and I have to fax a letter explaining everything along with copy of current visa and DS2019. I did that, but do you guys know how long should I wait until I do something else? I can imagine they get a lot of faxes every day and mine can just get lost there somewhere... any suggestions?
