View Full Version : B1 visa Extension
Hi
I have come to US 3 weeks back on B1 Business Visa.
At port of entry,I am given I-94 for a month.I have come here for 4 months period for valid business case.
I applied for extension of my stay for valid reasons.I filed form 539 with original I94.
But I have not yet received any reciept for my application from INS and the date of I94 is approaching.
is it legal to stay if receipt is not received before the date of expiry of I-94.?
Is it legal to wait for the receipt of application even after expiry date of I94 with just having the postal receipt which shows that application is received at INS.
Thanks in advance to immihelp for ur advise.
Regards

As long as you filed extension before expiration of I-94, you are fine.
Thanks for ur response.
I have taken a money order for the fee payable to "Immigration and Naturalization services".is it fine.?
Incase if i return back before i get receipt or Approval, can I submit photocopy of I94 at por tfo entr yalong with postal acknowledgement ? will I have any problems in future travel to US?

That is not fine. Read www.immihelp.com/visas/extend.html (http://www.immihelp.com/visitor-visa-extension/)
Which is not fine ? Sending by money order payable to INS ?
Form I539 says I have to attach original I94. incase if I dont get a new I94 and i plan to leave before i get a decision on my entension application , i can not give a photo copy of I94 at port of departure..? u mean its not fine to return a photo copy ?
Thanks

Immigration and Naturalization Services is old name. Money order in that name is not fine.
You have to send copy of I-94. Do NOT send original.
if they do not accept fees payable to INS,would they give me a chance to resubmit the fees correctly(its already 4 weeks ,not received any receipt from INS)? in that case if my already I94 date expires and fee payment is not accepted ,will i become ineligible to apply again for extension with new correct payment as date of I94 is over.?
Thanks immihelp in advance

I am not sure. The form is old and still says INS. Therefore, they may accept it. I can't say for sure.
Correct name is 'Department of Homeland Security' to write the check.

Hi,
I was just browsing the INS site for some information and I found ,that this information would be helpful for the immihelp.com users. here is the URL. Regarding the fees it looks like they are still accepting fees payble to INS. but the correct name is "US Citizenship and Immigration Services".
uscis.gov/graphics/fieldo.../fees.htm. (http://uscis.gov/graphics/fieldoffices/fees.htm.)
Thanks,
