Hi All,

I am GC holder and my mother-in-law visting us on visitor visa. She got 10 years multiple visa and I-94 stamped for 6 months expiring in Sept end. I want to extend her visitor visa. Question i have is;

1) if i apply for extension and somehow it got rejected....will this impact her 10 years multiple visa....in other words after rejection of extension can she come back to USA after 3 months?

2) if she granted visitor visa extension...normally for how long extension is granted for?

2) We are planning to go to (Fly) Canada...on her way back will she get new I-94 stamped with another 6 months extentions....does it matter which city we go to canada?

1. 10 year visa will be void. She has to go for new visa.
2. Whatever you ask for, max. 6 months.
3. You can't extend stay in US like that. New I-94 will NOT be given.

Hi,

I have a question regarding the reply from immihelp.

How Can they cancel 10 year visa If the extension is denied.?. Do we need to send the passport along with the extension request.?
Please clarify ..

It is cancelled under section 222(g) of INA. When the visa is cancelled, they don't have to stamp or strike off the actual visa stamp in the passport. They just make an entry in their computer.

That means, if you try to enter US with that visa stamp againn, you will not be allowed.

Do they let us know that it is cancelled.

As I said earlier, it is considered cancelled automatically. They don't tell you.

Immihelp,
Is it something that changed recently, or has this rule been there all along? Someone I know got their extension rejected couple of years back and never travelled to US again, and they have 10 yr visa too. Is there a way for them to verify this before they make their travel plans?

I am not sure exactly when they rule came.
