To whom it may concern,
My mother died this week. I'm currently living in Oakland, CA. I came to the US in 2007 with a J-1 Visa as an Au Pair. After completing the 1 1/2 year program on 2. June, I married my boyfriends of one year on the 6.6.2009. We are ready to file the I-130 and the I-485 next week. I'm in my travel month as an Au Pair and can legally stay here until 2.July.That's the date where I still have the booked flight of my Au Pair agency. I was about to cancel that flight, but after the dead of my mother I want to use it.
On 6-23-09 my mother died very unexpectedly and I need to fly home to Germany to be there for the funeral and my little sister. I already talked to the people at the USCIS in San Francisco, they told me that I'm not allowed to come back until my files are approved. Since me and my husband didn't file yet I can't get an Emergecy Travel document.The women there said, that I might be able to file my I-130 at the American Embassy in Germany. But I read today that this is not possible since 2006.
Is there a possibility of going to Germany and getting the permission to get back to my husband? At that point of time our papers should be pending. Or should I just go to Germany and apply there with my papers?
I don't understand why I would be allowed to go to Germany and come back as a tourist and marry then, but I can't come back if I'm already married to a citizen.
I need to go to my moms funeral but at the same time I need to be able to come back home to my husband to go on with my life.
Please, please hep me!
