My wife has an interview date set for December 14th at USCIS Fairfax (VA) office at 10 AM. I was wondering if this office would allow an oath on the same day or would they ask her to come at a later time. Thank you in advance!

Also, I am on H1B visa (got EAD through work) and I have my I-140 approved through F2A (family based green card - 2A category) couple of months ago. Do I have to wait until my wife gets the US passport before applying for adjustment of status (485)? What documentation do I need to provide for 485? How long does this 485 process take? We have been married for more than 4.5 yrs.

Any information is greatly appreciated.

Normally the Fairfax office offers same day oath depending on what time your interview is. Your wife has to be a citizen before you can apply for the I-485. You will have to show evidence of marriage ex: joint car loans, mortgages, joint utility bills. To find out more you may want to look at USCIS.GOV and look at the form along with the processing time. When I sent mine back in 2005 it took a little over a year, however USCIS has become more proficient in the last year or so. It may take 6 months or less. Hope this helps.
