Hi,

My wife is traveling with my 2 month old son from India to USA. She is green card holder and I am US citizen. My son was born to Surrogate mother (some one else to carry the baby for us) and got Indian passport.

US consulate given me print out that if the child is under 2 yrs old with valid Birth cerfitcate and passport can travel with mother who is US green card holder without VISA. Child's status will be adjusted at the port of arrival.

My question is would there be any issue in Indian Immigration for the child to leave?

What kind of status my son gets in US.

Just carry that print out and the Indian passport. People at the immigration in India know about this.

Once your child arrives in the U.S., he will become permanent resident immediately.
