View Full Version : Can I contuniue GC through my old employer?

My understanding is, GC is for future employment. I have changed the company through which I have approved
I-140. Now that PD/EB3 is moving fast I will be able to
file for I-1485 soon. My question is:

1. Can I continue legally with I-485 with my previous employer (employer has no problem with that)
2. What problem I could anticipate. Will I be OK? Has anyone done this?

Please advise. TIA.

No problem in your case. INS does not mind if your previous employer does not discontinue your processing.

Hope you are doing well at your new job!!!
You can definitely continue GC and file I-485 even without leaving your new job if your old employer agrees to issue you a future emploment letter for filing I-485 expecting you to join them back after your GC approval. This is the only document you need from your employer for filing I-485.

Can I apply for GC thru OLD & NEW employer?
While I485 with old employer is pending, can i file for labor RIR thru new employer.

Any technicalities/minutae on this? Thanks guys?

Also, what if i never go back to work for old employer after i get the GC? I am sure ins is not too efficient to find that out...? WHat do gurus on this think...?
