I have a 2yr old son who was born here so is entitled to US citizenship. However 1 month after his birth we had to go to India and since his SSN was not available then, we got Indian passport for him based on our Indian citizenship.

Now that India allows dual citizenship, can he also get a US passport and keep his Indian passport as well. Can his US passport application be submitted at any US consulate?

Hi Sinha,

US born baby is always a US citizen, You can get your baby's US passport using birth certificate by surrendering Indian passort at any time :p .

Hi,

I have a similar problem.
I am wondering if I can apply for H4 visa for a child who is born in the USA but has only an Indian passport - no US passport.
We do not want to get an US passport, since that means we have to surrender the Indian passport. Will the consulate allow H4 visa processing for a child born in USA?

Thanks,

Yes, you can get H4 visa.

However, just out of curiosity, may I know what do you want to retain Indian citizenship for your child? Isn't it easier everywhere being US citizen (Of course, other than reasons like being able to travel to Cuba, or some terrorist kidnapping because he is US citizen)?
