View Full Version : Travelling on Visa Waiver Program while i-130 Pending

G'day!

I am married to a US Citizen and wish to travel from Australia on the visa waiver program, whilst I have an i-130 pending for myself and my son. I am an Australian Citizen. I strictly ONLY want to travel there for a brief 3 week holiday for his sisters wedding and return to Australia.

I have the following:

- 1 return ticket (Just for myself, my son is being cared for by my parents for 3 weeks)

- I am the sole carer and have cared for him the whole 3 years, have documentation signed by 2 Lawyers stating I will return to the commonwealth of Australia to care for my son.

- 1 letter from the Real Estate agency stating an inspection in the precense of the Land lord (Myself) is to inspect the property just after I get back.

- Wedding invitation - date of wedding - purpose of travel

Could someone please advise as I would be devasted if I am turned back home. Its a bloody long way to travel.

Hey,

Im in a similar position, my husband is a US citizen and he has been on active military duty in Afghanistan and I want to visit him when he gets back in Dec.. Im from sydney and was wondering whether everything worked out for you when you tried to visit the us while filing your i-130 petition.. My hubby and I just got our NOA2 im so nervous about entering.. but I wouldnt miss his return for anything in this world!!!!!!!!!
