  • 2nd I-130 or 2nd petition file.. Can i Do this?

    Hi, I am 26, unmarried (India), student (F1) visa holder since 2006 in USA, my sister (citizen) filed petition for me in 2008 January. My parents have green card since March 2009 and they also want to file petition for me now.

    So is it advisable to file second i-130 (petition)?
    further, Which one takes less time to get me green card??..I mean to say through my parents ? or through my sister ?

    And what are the chances to arise a future problem because of two petition files running at a same time ??

    First of all..you can have as many petitons for you being filed concurrently. There is no problem in it.
    The petiton from your parents is likely to be a bit faster then the brother and sisters of US citizens..As of now the file which your sis has applied for you falls under f4 category and might take 10-12 years to be current..which means you will be 38 years of age. If your parents sponsor for you..then it wud take roughly 5-6 years..so you will be like 32 years

    Ask your parents to also file for you asap.
