View Full Version : Already Mutually Divorced in US , but ex-wife filed lawsuit again

Hi all,
Me & my ex-wife are INDIAN Citizens.we got married in INDIA and then living in USA since then from 2008. One time we had visited INDIA for 15 days in 2009. I am in H1-B visa and had been residing in Florida, for past 2 years. (living in USA for more than 9 years) On last year 2010 , mid august I filed for divorce, and we had an mutual uncontested divorce where I gave half of my property to her, as demanded by her .She signed all the papers and receipts as needed by my attorney to complete the process and then FLORIDA court gave us the decree of divorce, last year. Then she went to INDIA with all her assets as decided on the marital agreement.
After that she went to INDIA and last week she filed a matrimonial suit against me, demanding that she dont obey the US law decree for the divorce
and issued an injunction against me for not getting married for next 1 month.
(I although dont have any plan for remarriage , right now at this moment).Her lawyer from INDIA sent my employer a registered mail, explaining these things, and my employer forwarded that mail to me.

Now the question is ,though My parents & relatives in INDIA already hired a reputable attorney since my US attorney told that once your INDIAN attorney provides all the DIVORCE documents to INDIAN court, you will be all set.
IS that true?
what other consequences can I face, since we both divorced amicably over here ?
what are my best options right now, since I want to come out of this trauma ?

I believe that your divorce in the U.S. would be considered valid in India. Your Indian attorney should submit your U.S. divorce papers to the Indian court.
