Domestic assault and TN Visa

Hi all,

Thanks for your help in advance. I am a Canadian Citizen and have a job offer from the US. My wife and I had an argument and she called 911. I was arrested and charged with domestic assault. My wife tried to drop the case but the Crown does not agree...I have not gone for the trial yet so the case is still open with no sentence yet.

If I go to the border to apply for a TN visa to enter the US now and before the trial date in Canada, will I get the visa?
