View Full Version : Is petition denial and visa refusal is same ?

Hi,
I have got my petition denied for L1B during Feb,2005 .
June 23 i have a interview for H1B.
So i was in process of filling DS156 Form.
In DS 156 Form, the question no. 31 is "Have you ever been refused a U.S. visa?"

Is my L1B petition denial is also a refuse for a U.S visa?
Should i answer "Yes" for question no 31.

Please let me know ASAP.

Did you find any answer to your question? I would appreciate if you let me know if the two cases are same or not. One of my friend is in similar situation. His H1B petion was denied once and now he is going to go for this H1B stamping to Mexico.

From what ever i have understood , petition denial and visa refusal is not same. Visa refusal has happened only if "Application recieved" stamp is printed in back side of the passport.
