My fiancee, who is an Indian citizen, came to the US on a J-1 visa for surgical training. She has decided that she does not want to be a surgeon and has left her post and returned to India. I am a US citizen living in New York. She and I plan to marry at some point next year. Since she did not finish her surgical training does she still have to abide by the 2-year home return provision even if she gets a waiver from the India government? Thank you for your response.

You mean NOC from the Indian govt.
Medical residents on J-1 are not eligible for a J-1 waiver
based on NOC issued by home country govt.

In the prsent scenario , she will have to complete the 2yr home country requirement. There is another way to get a waiver but only after
both of you are married;
If you can prove extreme hardship to you if she stays in India.

I would prefer you to contact US embassy,newdelhi in this regard.The Indian embassy in the US will not issue NOC once the J1 participant left the country.
