Dependents for tax filing on H1b

Hi All,

I am in H1b Visa and my wife is on H4 visa.

My wife is not working (as she can not work on H4). And she can not have SSN as per my understanding.

To declare her as dependent on me while I file Income tax return, (to get tax benifits) what should I do?

But, I came to US in Feb 2012 only. So I think I will get w2 in 2013 and need to file my tax return in 2013 only.

Does that mean..

My wife can apply for ITIN only when I am filing my Income tax return, not before that?

I think so. Read form W7 and instructions on IRS website. I think it can only be filed if accompanied by a return. Why else do your dependents need it?

I am also H1b visa holder came to USA on June 10th 1012 . And my Wife and my kid came after me with H4 visa on 10th August 2012.

I have my SSN , But my Wife and kid are not eligible for SSN as your case .

I hope you got those information how to file the tax

You have to file tax manually( not online). And send application for ur wife and kin's ITIN along with your return.

Hello Kingks, are you planning to send original passport along with the tax return to get an itin? my wife has never been to USA, so can i do married filing jointly? if yes, how can i get itin for her? she is in India still. Please help. Thanks.
