  • H1B Transfer while in india

    I'm in india working for company A and having valid stamped H1B till sep, 2013. I never traveled to USA.
    I got an offer from employer B in india and they are ready to file H1B transfer for me. They are going to place me as an permanent employee in their USA office. They gave me a USA offer letter also with all wages details.

    I have the below questions, please clarify..

    1) If company B gets the approval from USCIS, do i need to go for stamping again? Is it mandatory?
    If I go for stamping what will happen to my previous stamped visa in passport?

    2) how long will it take to get the approval from USCIS in non premium mode?

    3) Shall i ask the company B to file the H1B transfer now itself, i mean before i join the company B? is it possible?

    4) Is it safe to join the company B before they get the transfer approval from USCIS for my petition? If it is rejected what will happen?

    5) I'm planning to re join Company A in future, is it possible to use my previous visa which i got from company A? Do they need to file H1B transfer again from company B?

    >>> You can use the existing H1B visa in the passport along with the new approval notice to travel. No need to go for stamping again.

    >>> Yes.

    >>> If it gets rejected, then you cannot travel. What exactly are you trying to ask?

    5) I'm planning to re join Company A in future, is it possible to use my previous visa which i got from company A? Do they need to file H1B transfer again from company B?
    >>> If you are planning to switch from employer B to A while in U.S, then a transfer need to be filed. Alternatively, you can leave U.S and return back using a valid H1B visa and employer A's petition and start working for employer A.

      Thanks for your response.

      I wanted to travel soon and that's the reason i'm changing my employer. If my new employer's H1B gets denied, all my plan will be down. That's why i asked whether it is safe to join company B before they get the approval from USCIS?

      And my current employer has filed an amendment in premium mode with USCIS but i decided to join company B now. They are going to file a H1B transfer for me. Will both impact each other?

              H1B transfer or Petition transfer from India

              Hi

              I have H1B visa through company A and is valid till March 2013. I already traveled to US last year and have 3 paystubs (last worked in Dec 2011) and W2. I am now in India and there is no onsite project with company A in which they can send me to US. I found a consultant in India - Company B - who is ready to send me to US. They are going to file a new petition for me. Now my question is:

              1. Is it legal to travel to US with visa from company A and petition from company B?

              2. Do I need to go for stamping before I travel to US for company B's assignments?

              3. I heard that, during the last 6 months of my visa validity period, if I travel to US, I might face issues in the immegration in port-of-entry in US. Is this true?

                >>> Not required as long as you have a valid H1B visa stamped in your passport as of the date of travel (irrespective of the employer name), you can use it.

                  Have you transferred H1B transfer using myconsoft. Are you working in myconsoft now? do you know, how good the consultancy is?

                    Hello, Suresh.

                    I do not find anything negative about Myconsoft on Desicrunch and Yelp. Which does not mean that everything is fine, but it is encouraging to see no negative reviews. E.g.: If you search for other Desi IT consultancies (like Beta Soft) , they are filled with horror stories.

                    So, seems ok, so far. Keep googling Myconsoft reviews and see if you stumble upon something problematic.

                      H1B Transfer while in india

                      I was initially in touch with them (Shelly and Andy) before I came here but did not transfer my h1 to them for some strange reason. I am not sure about their conditions but be sure when you sign documents for them.

                        Thanks for your response. I verified in google someone said good, but someone said bad. I am not able to conclude from here.. Currently they are asking $3000 dollars to deposit for H1B transfer.. Not sure, they have good clients from their end.

                        Is it possible for you to share anyone who is working in Myconsoft.. It will be helpful for me. I will tocu base with him to get some clarification.
