    My situation is that I'm on a J1 Visa doing a medical residency and my 10 year Indian passport is expiring. I have a valid DS 2019 and I-94 but my J1 Visa stamp in my passport has expired. Is it permisible for me to renew my Indian passport in the US even though my J1 Visa has expired? The VFS website says I need to go to the Indian Consulate and provide them a No Status Affidavit, photocopies of passport and green card of two witnesses duly notarized and 7 copies of National Verification Form. According to VFS, the Indian Embassy will provide written authorization to renew. Is this truly necessary or are the J1 Visa holders exempt if they have a valid DS 2019 and I-94?

      I got similar situation as well, I'm on a J1 Visa, working as Post-Doc research Associate & my 10-years Indian passport is going to expire soon. I have a valid DS-2019 and I-94 as well, however, my J1 Visa stamp in my passport has already been expired which is very standard on a J1 category. In this case, Am I eligible to apply for Indian Passport to get renewed in the US even though my J1 Visa has expired? The BLS International website says I need to go to the Indian Consulate and provide them a No Status Affidavit, photocopies of passport and green card of two witnesses duly notarized and 7 copies of National Verification Form. But when I emailed BLS, then just simply replied me back that I cannot get it renewed unless I have valid visa here. Could you please kindly share your experience(s), if any, whether is it possible to get my Indian Passport renewed without a valid J1 Visa, but having a valid DS-2019 and I-94?

        Passport Re-issue with a valid DS-2019, I-797 and I-94, but expired J1 visa

        Hi,

        I am also exactly in the same situation.

        My passport is expiring in March, 2015 and I am planning to get it renewed. My J1 visa has expired, but I have a valid DS-2019 showing legal J1 status (till December, 2015), I-797 and I-94 (stating D/S "Duration of stay" status). Can I apply for passport re-issue with valid DS-2019, I-797 and I-94, but with expired visa? Has any of you got it working?

          I too had a similar situation. My J1 visa stamp expired on Dec 2013. So for passport renewal, I send my documents along with the notarized copy of DS2019 form highlighting the dates that my J1 visa is valid (2011-2016 in my case).
          I got my passport in ~2 weeks.
