  • VWP - New stamp when returning from Mexico

I am an EU citizen. Over the last few years I have been travelling to the US quite frequently, always on VWP and have never had any issues.

Earlier this year, I had gone to the US for about a week, travelled to Mexico for about 2 weeks, and then returned to the US. Knowing the rules about trips from US to Mexico and Canada counting towards the 90 days in your VWP, I didn't expect to get a new stamp.

In immigration, when returning from Mexico, the officer asked quite a few questions about the travels, etc.. He finally gave me a new VWP stamp, with an expiration date 90 days from the time of re entry (the expiration date written on the stamp).

I eventually decided to stay in the US for about 85 days from the date of re-entry, considering that it was within the limit of the new stamp.

However, I now start wondering whether this is normal practice? Will it get me in trouble in the future, seeing as, if immigration looks at my travel records, they will see that my total US-Mexico-US stay duration is more than 90 days. However, I have obviously not exceeded the limitations of either of the VWP stamps in my passport.

Looking forward to hear from you!
