    Hello all, thanks in advance to give me some answers.

    My situation is a little complicated, please be patient and read the whole story. And there are a few questions:

    I have been living in US since I was 13 and never traveled out of the country. I traveled once outside the country because of my boyfriend ( we met at work when he was on his OBT) is serving military service in TW (involuntary drafted), i stayed in TW for 8 months, when I re-entered US, they questioned me but still let me back in, and put a 8months / admit stamped on my Chinese passport.

    1. My greencard is expiring in Dec, i booked ticket leaving Oct and wanted to stay till Feb. I submitted i-90 renewal but still haven't heard back yet. What should I do? Is there anyway I can get a stamp to extend my greencard when I did not get a notice yet (no fingerprint, no receipt notice yet)?

    2. Will there be any re-entering US trouble if I travel out of the country? (will make me 11 months out of a year)

    My boss verbally agree I can return to the position upon I arrive US. I have been keeping my bank account and cell phone account in US. I filed tax in 2012. I live with my parent in their house.

    They questioned you because staying 8 months outside of the country is a bit too much. If you were a citizen nobody would ask you anything - but as a resident, being outside for eight months is a bit too long.

    There are two issues here:

    a) You already stayed outside the country for eight months. And now you're going for five more months. Bad idea. There's no doubt in my mind CBP will send you to secondary inspection. And there's a non-trivial chance they'll ask you to surrender your green card. It seems like you're staying most of your time outside the country - hence, you're not a resident.

    b) while an expired greencard would allow you to ENTER the country, the airline may not allow you to BOARD THE PLANE with such an expired green card.


    In short: don't do it. Wait to get your new green card. Stay in the US for some time (say, four or six months) Go visit your bff. Stay outside the country for a month. Come back. Stay for a year.

    Again: you're spending too much time outside of the country - hence, you don't RESIDE here.

      need to travel out of US with extension upto Dec 2014

      Hello Immihelp experts,
      I am travelling to India for 4 weeks and have a PR card that expires Dec 2014.
      The card originally expires Aug 6 2014. I have an extension sticker that says valid till Dec 2014.
      I have done fingerprinting and my I-90 is pending with USCIS. have the I-797 notice of action.
      Question:
      Is this sufficient for travel ? Since card is expiring within 6 months would airlines/immigration
      have issues ?
      Will I have any problem during reentry.
      I saw on immihelp that stamping is needed on the passport. Is this still valid. I was not
      offered a stamp when I went for my fingerprint. Should I go back and get a stamp on my passport ?
      Not sure how to get an appointment for that.
      Is the sticker and I-797 good enough ?
      See different informations online. Hence please clarify.

        If there is any possibility that you will be out of the U.S. beyond December 2014, you should get an INFOPASS USCIS appointment and ask for an I-551 stamp in your passport, which would normally give you a year (from expiration of your Green Card) proof of Permanent Resident status.

          Will I have any issues at stop over points or return? Dont plan on going out of airport.
          Is it worthwhile making an infopass appointment ahead of time ? Can it be done in India ?

            An INFOPASS appointment is for in-person interviews in the U.S. at a USCIS office.

            Your unexpired Green Card or your I-551 stamp should give you authority to board a U.S.-bound plane and to pass through the Port of Entry processing in the U.S.
