I am a US citizen who is going to marry a girl who has overstayed her visa. We have 12 days before her visa will be overstayed by 180 days. Is there a benefit to marrying before the 180 day period comes and goes? We were wanting to wait till June. I spoke with an attorney, and was advised to marry now, but it was on the phone and she didn't give me an explanation as to why to marry now. The reason I didn't ask was because I haven't retained her yet. I would like to do the filing myself. I understand the possibility of her deportation now, and that marrying her and filing the I-130 gives us some power, but we had hoped to wait till June. Thanks for your assistance.
