I797B: transfer before stamping
Hi
I would like to know whether I can get an H1B Visa without Lottery system in the my current scenario ?
Scenario is …
I was working in a company A and they have applied for H1B visa . Application got approved and received i797b (I have received a Photocopy of the i797b) . But for some reasons I didn’t go for Visa stamping and resigned form that Company . I joined a new company B and never traveled to US. This happened approximately 3years back and now passed the validity date in i797b.
Now I am planning to take an H1B visa via new company B. If so Do I have to go through the approval process (Lottery system )again to get i797b? Or Can my current Employer can make use the i797b I received before by renewing and transferring the Approval? If So what may be the formalities I may have to go through and how long it may take to get H1B
