  • J1 visa with prior dv app

    Hi there

Im very worried about this particular situation. Im a Canadian citizen who is in the process of applying for J1 for medical residency training in the US; awaiting an interview date. Have been offered a position in the US that starts in July. However, I recently read that a prior DV lottery application can cause issues. The honest truth is, I had no idea this actually meant anything. I literally thought it was a lottery and figured in the slim chance I won, it would be a long process and I would actually need to file a proper application; which I don't think I would ever do. I really do want to come back to Canada to practice. I have no intention of living/working in the US permanently because all my family is in Canada. The only reason I put in an application was because my fiance suggested that it might increases my chances of getting a medical residency position if hospitals didn't need to sponsor a visa for me. It was very last minute; the night before and we didnt think much of it. How bad is this? What should I do? or say at the interview? Can they actually see that a lottery application was put in? Pleaseeee help! Thank you

    Shashi

Also, anyone with recent J1 interview experiences; in Canada maybe, can you shed some light on what kinds of questions they ask?

J-1 requires a non-immigrant intent .And by participating in the lottery, you have demonstrated an intent otherwise. They ask you about past immigrant petitions
in the application form and you will have to mention about filing for the lottery.

That said, it is at the discretion of the officer.

You had another option, probably you know about already; taking USMLE step 3 and asking the program to file an H-1b petition rather than a J-1.
There is no problem of an immigrant intent with an H-1b.

the hospital does not sponsor H1B- took step 3 and everything.
the application asks. "has anyone filed for an immigrant visa on your behalf"- i put no. because no one filed any visa on my behalf. If asked about the lottery, i will say yes. but explain no intent at the time or now. which is the case since i have every intention of going back to Canada.

well if they find out about the lottery application, they may deny you. Whether applied with a different intent , participation
in DV lottery is proof enough of immigrant intent. That is how the visitor visa process is.
To give you another example of how they determine intent. People who officially give up their green cards obviously have no immigrant intent anymore
but they find it very hard to get visitor visas because they had an immigrant intent in the past.

If denied, you look for a program that will file an H1b for you . So many programs do that. You just have to look for one.
That is the only way you will have.
