L2 Extn , L to H conversion, PERM applied

  • L2 Extn , L to H conversion, PERM applied

    Hi,

    I am currently with L1B which expires on Sep 7 2014. My company applied for L1 extn in normal processing.
    My company also applied for L to H conversion and waiting for the lottery result.
    Also my company applied for PERM last Dec and waiting for Labour.
    My questions are

    1. I am expecting to get I-140 around Sep 2014 , what are the chances of getting L1B extn with approved 140.
    2. If i did not get selected in the lottery and got L1 Extn, can i stay in L1B for more than 5 yrs?
    3. Do i need to convert to H1 if i get L1 B Extn and 140?

    Please reply.

    When is your 5 Years physical stay completing? Is GC filed under EB2/EB3?

    1. L1B extension and PERM are two different processes one does not influence the outcome of the other.
    2. No. L1B is for max 5 Years physical stay. If you want to stay beyond 5th Year either move to L1A or get H1.
    3. Not necessary but advisable to do so as eventually you would have to if under EB2/EB3. But if you looking at benefiting from spouse to work on L2 then you can avoid moving to H1 to a later stage again Max only 5 Years beyond which you would have to move to H1/L1A.

    Also the subject says something about L2 but no question was asked.

      My 5 years L1 getting completed on Sep 2015.

      There is a typo in subject , it was L1 Extn
