  • H1b Stamping .. First time going to India after 6 years

    Hello All,

    Thanks in advance!

I have one question and it is about H1b Stamping.

I came to the US in Aug 2008 for studies after that I finished my degree and came on OPT and then my company got H1b for me. Today now it is 2014 and I never went back to India in last six years. Now I am planning to go to India soon and need to get H1b Stamping done, I am confused that which place would be good for me (whether India or Canada) in regards to stamping.

Please reply this post. It will be highly appreciated!

    Same situation

Hi Ashu55 - I am in a similar situation. Do you have any updates. Is there anyone else has been in the same boat where they hadn't gotten their 1st H1-B stamp and went home after 5-6 years to get it done? To make this more complicated, my I-140 is approved.

The first stamping should be in home country

One of my friends too in the same situation. But neither of us went back to India and now both of us thinking to go back. I do not know any person who went to India/Canada for H1b Stamping. I hope you will get stamping easily.

Thanks Snehanew for your suggestion. Have you ever seen or known any person who has been gone through this situation?

          Hello gatechgnome,

I have not still gone to my home country yet, but I am planning to go in Jaunary end. I have not seen any similar case to mine yet. Thanks for your comment though.

As your predominant experience as well as Master's was from US, I think you should be fine.

Evidence of qualifications must original or certified copy. Consular officers in Canada may refuse to issue a visa to H-1B applicants if their education and/or work experience is solely or predominantly from a country other than the U.S. or Canada.

Consular officers in Canada may refuse to issue a visa to first-time H1B applicants if the applicant's education and/or work experience is solely or predominantly from a country other than the United States or Canada. In the absence of U.S. or Canadian education or work experience, we strongly encourage you to apply from your country of residence.

This is my opinion not legal advice.
