  • International travel - H1B visa

    Hello,

I am currently working in company B on H1B visa which is valid till July 2016.
Last year, I moved from company A to company B. On my passport, my H1B Visa is stamped from company A and is valid till Nov 20 2014. My I-94 (still paper based) is also valid till Nov 20 2014.
Now, I need to travel to Germany in Oct 2014 for a week. I will be back by Nov 2, 2014. I understand that technically I can visit Germany and return on the same H1B visa of company A valid till Nov 20, 2014. The only task I need to do is to ensure that the new I-94 that I receive while entering US on Nov 2, 2014 should be based on my company B's H1 expiration date of Jul 2016 and not company A.
Can some one please help me with following:
    1. How can I ensure that my I-94 while return is valid till Jul 2016 and not till Nov 20, 2014?
    2. Is there any complication or issue while applying for my Germany Visa considering my current Visa stamping?
    3. Is there any complication or any potential issue while returning to the US from Germany considering my situation? If so, please advise.

Eagerly waiting for a prompt response. (Request attention from Senior members)

    Thanks in advance!

    1. You can only request the officer at the port of entry to grant I-94 as per your latest I797. If they however refuse, you cant do much. If you have visa, passport, and I797 all till 2016 then the chances are very high.
    2. Dont see issue in applying for Germany visa.
    3. As said, whether you get I-94 till 2016 or not depends upon the officer.

This is my opinion not legal advice.

Thanks raghvi for a prompt response.

When you mentioned "chances are very high", did you mean chances are high of my getting I-94 stamped till 2016 or only till 2014?
Are there any tips / suggestions to ensure I get my I-94 till 2016?
