  • Confusion to decide Visa Interview Location Canada or India H1 and later H4

    Hello dear members,

I got my H1b approved and now its time to get it stamped as I have to travel to India for my marriage in November.

    My situation :
    - I work on EVC model
    - client, vendor and employer are supportive enough to give me their respective letters and I have all my documents for visa interview
    - I have my OPT until Jan next year
    - I have to get my visa stamped(H1) if i go to India for my marriage in November

    Please suggest :
    - Which would be best for visa interview location,
--- Goto Canada in October for H1 based on result, return to US and then travel to India without any tension and apply H4 for wife and return to US together
    OR
--- Go to India and go for visa stamping together H1 and H4 and based on the result come back to US

If you are getting visa appointment for Canada go for Canada. But first check the Consulate in Canada as it seems they are not currently entertaining TCN for H1/L1 stamping.

This is my opinion not legal advice.

Hello Raghvi, thanks for responding. I checked the Canada US consulate website (Calgary, Vancouver, Toronto) and they don't say that u can't get done your first time visa from F1 to H1.

I still haven't booked any appointment date either in India or Canada. I want to know which one would be beneficial for my situation.

          Thanks,

It's getting very difficult to find a desired date in Canada for stamping due to heavy demand by Canada-based visa applicants. However, Any consulate(Canada or India) is fine these days for Stamping if you have proper documents.

Thank you Harry, Although I would be going in October, I would go to India(chennai) with my wife and get done my H1 and H4. Spoke to couple of advisers and they said its good to go to home country for first 1st time stamping.

Couple of friends said that, in-case if anything happens in India like RFE or any other delay, then its better to wait up at home than in Canada or any other for that matter.
